Isn't there a disclaimer that says that while creating your modded content for the game IW owns full rights to the mod and the code that has been created? His copyright claim has no legal backing, as much as I hate to say this.
Joker FTW.

thats what they get
Never mind what haters say, ignore them till they fade away...
Regardless of what a EULA says a court of law will always place intellectual property rights above a non binding EULA.
The problem he faces if representation......IW is effectively marketing the largest piece of entertainment media since the movie titanic, they will make more at midnight tonight than the top 3 blockbuster movies did all year on their opening weekend.......they will have their high priced lawyers bury him paper work and he will not have the monetary funds for proper representation......or they could simply give him credit for his intellectual work........
ffs he isnt trying to have it removed from the game or anything. If you ask any modder then you will know that they simply want a bit of recognition, i know id want some for my mods. another point to note is that they asked for it when they announced there will be no mods for mw2 especially seeing mods are what made the whole series. Thats what pissed off the modding community. finally everyone knows what the EULA states, we simply dont care.
*EDIT*
nvm. just read the rest of the thread instead of just the first page lol
